Statement From A.G. Schneiderman On The Passage Of The Consumer Credit Fairness Act

NEW YORK – Attorney General Eric T. Schneiderman issued the following statement in response to the passage of the Consumer Credit Fairness Act in the New York State Assembly:  

“I applaud the Assembly for passing the Consumer Credit Fairness Act, which will ensure due process protections for consumers when debt collectors attempt to collect on debt by using the judicial process. If it becomes law, this legislation will provide important notice to consumers that a suit has been filed against them, and require collectors to prove that the debt is legally owed to them based on statutes of limitations and other requirements. Similar to Chief Judge Lippman's proposed reforms to the legal process for consumer credit cases, it will promote an overall fairer system for thousands of New Yorkers.

"Thanks to Assemblymember Helene Weinstein for her leadership and sponsorship of this legislation. I urge the Senate to take up this measure and help put an end to the abuse of consumers by debt collectors in our state.”
