Mina Maxine Gayle-Campbell Caught On Video Allegedly Mistreating A Nursing Home Resident During Bed Bath
Schneiderman: Physical Abuse And Mistreatment Of Our State’s Most Vulnerable Citizens Will Not Be Tolerated
BROOKLYN— Attorney General Eric T. Schneiderman today announced the arrest and arraignment of Mina Maxine Gayle-Campbell, a Certified Nurse Aide on charges she repeatedly struck and mistreated a resident at Shore View Nursing and Rehabilitation Center in Brooklyn. Gayle-Campbell allegedly failed to provide appropriate care to the 82 year old resident suffering from dementia during a bed bath, for which she is charged with hitting and abusing the resident. The incident was captured on video according to court papers.
“When families make the difficult decision to place the care of their loved ones in the hands of a nursing home, they expect them to be treated with compassion and respect—not abused and mistreated,” Attorney General Schneiderman said. “My office will continue to prosecute anyone who abuses and mistreats elderly and vulnerable New Yorkers in this way.”
On April 29, 2015, Gayle-Campbell was responsible for providing care to a nursing home resident who suffers from dementia and is unable to care for himself. Instead of giving the bed bath in a manner that protected the safety and dignity of the resident, Gayle-Campbell was captured on video allegedly striking the resident, throwing water at the resident’s face and body and using the resident’s own fist to strike him in the face.
Gayle-Campbell, 45, of Brooklyn, was arraigned on charges of Endangering the Welfare of an Incompetent or Physically Disabled Person in the First Degree, a Class E felony, and Wilful Violation of Health Laws, a misdemeanor, before Honorable Cenceria P. Edwards in Brooklyn Criminal Court. The alleged acts of abuse and mistreatment potentially violate facility policy and state laws that protect nursing home residents.
The charges against the defendant are accusations and the defendant is presumed innocent unless and until proven guilty.
The case was investigated by Special Investigator Richard Palastro of the Attorney General’s Medicaid Fraud Control Unit with the assistance of Supervising Special Investigator Mitchell Scher and Deputy Chief Investigator Kenneth Morgan.
The case is being prosecuted by Special Assistant Attorney General Crystal Barrow of the Medicaid Fraud Control Unit’s New York City Regional Office, with the assistance of the New York City Deputy Regional Director Larissa Payne and New York City Regional Director Christopher M. Shaw. Thomas O’Hanlon is the Chief of Criminal Investigations-Downstate. The Medicaid Fraud Control Unit is led by Acting Director Amy Held and Assistant Deputy Attorney General Paul J. Mahoney. The Division of Criminal Justice is led by Executive Deputy Attorney General Kelly Donovan.
